All sales are final.
New subscribers receive a 2-day Pro free trial (payment method required at checkout). Cancel in
the Stripe customer portal before the trial ends to avoid being charged. If you forget to
cancel before the trial ends, you will be charged $5.99 and that payment is not refundable
except as described below or as required by applicable law. The full app requires an active trial or
subscription.
1. Scope
This Refund Policy applies to all purchases of Aether EQ paid plans, currently:
- Pro Monthly: US $5.99 per month after any applicable 2-day trial, recurring, with up to ten (10) guided EQ generations per calendar month (EST).
This Refund Policy is part of, and incorporated by reference into, our Terms of Service. Capitalized terms used and not defined here have the meanings given in the Terms of Service.
2. All Sales Are Final
Except as expressly stated in this policy or as required by applicable law, all payments for Aether EQ paid plans are final and non-refundable. This includes (without limitation):
- Partial billing periods, unused months, or unused days;
- Cancellation prior to a scheduled renewal date;
- Downgrade or cancellation after a paid period (no refund for unused time);
- Forgetting to cancel before renewal;
- Account suspension or termination for violation of the Terms of Service;
- Loss of access to a Google account used to authenticate with Aether EQ;
- Discontinuation of an individual headphone profile;
- Change in your subjective preference about the Service;
You acknowledge that the 2-day Pro trial allows you to evaluate the full Service before recurring billing begins, and that your decision to continue past the trial is made with knowledge of the Service’s functionality. Forgetting to cancel before the trial ends does not entitle you to a refund.
3. Immediate Digital Delivery and Waiver of Withdrawal Rights
Aether EQ is digital content delivered immediately upon successful payment. By clicking “Subscribe,” “Pay,” or any equivalent button at checkout, you:
- Expressly request that delivery and performance of the Service begin immediately;
- Acknowledge that you will lose any right of withdrawal, “cooling-off” period, or equivalent statutory cancellation right that may otherwise apply, including the 14-day right of withdrawal under Article 16(m) of EU Directive 2011/83/EU and equivalent provisions of the United Kingdom Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, to the maximum extent permitted by law; and
- Confirm that you have had the opportunity to evaluate the Service through the Pro free trial and non-subscription manual EQ features.
4. Limited Exceptions Where We Will Refund
We will, in our reasonable discretion, refund payments in the following situations:
- Duplicate or accidental charge: two or more identical charges within the same billing period, where only one was authorized.
- Fraudulent charge: a charge made with payment-method details you did not authorize, supported by reasonable evidence (e.g., police report, written cardholder attestation).
- Service outage: a continuous, verifiable outage of the paid Service for seven (7) or more consecutive days that prevents you from using the paid features, where the outage is not caused by your equipment, your network, a third-party service you separately control, or your violation of the Terms.
- Material misrepresentation by us: a feature was advertised on our site at the time of your purchase, that feature was a primary reason for your purchase, and the feature was not delivered.
- Where required by applicable consumer-protection law, including the Pennsylvania Unfair Trade Practices and Consumer Protection Law, 73 P.S. § 201-1 et seq., and any other non-waivable statutory rights in your jurisdiction.
5. How to Request a Refund Under Section 4
Email aether.eq.app@gmail.com within thirty (30) days of the charge with the subject line “Refund Request” and include:
- The Google email used to sign in to Aether EQ;
- The Stripe receipt number or last four digits of the card charged and the charge date;
- The plan you purchased (Pro Monthly);
- A description of which exception in Section 4 applies and supporting evidence.
We will respond within ten (10) business days. Approved refunds are issued to the original payment method through Stripe and typically appear within five (5) to ten (10) business days, depending on your bank.
6. Cancellation Is Not a Refund
Cancelling a subscription stops future renewals. It does not refund the current period. After cancellation you retain access through the end of the period you have already paid for, and guided EQ / community access ends when the paid period ends. To cancel:
- Sign in at aether-eq.web.app;
- Open the “Manage subscription” button in the account header to launch the Stripe customer portal; and
- Click “Cancel plan.”
7. Free Trial Cancellation
To avoid being charged after the 2-day Pro trial, cancel in the Stripe customer portal before the trial ends. Cancelling during the trial stops future billing but does not convert the trial into a paid refund (no charge was made). Trial eligibility is limited to one per account.
8. Chargebacks
Nothing in this policy limits your right to dispute a charge with your card issuer. We ask that you contact us first under Section 5 so that we can attempt to resolve the issue directly. Filing a chargeback before contacting us, or in bad faith, may result in suspension of your account and forfeiture of any unused service for the period; we may submit relevant transaction and Service usage records to the card network in defense of a chargeback.
9. Taxes
Refund amounts, when issued, are net of any non-recoverable transaction fees and inclusive only of taxes that we are legally required to refund.
10. Changes to This Policy
We may update this Refund Policy from time to time. The version in effect at the time of your purchase governs that purchase. We will give at least thirty (30) days’ notice of material changes by email or in-app notice.
